CIPA UPC Conference 2026

Following the success of the inaugural event last year, we are pleased to announce the second  CIPA UPC Conference, a landmark event dedicated to exploring the ever-increasing importance and impact of the Unified Patent Court (UPC), and the role of UK patent attorneys within this system.

Now over two years since its launch, the UPC continues to reshape the European and global patent landscape. This one-day conference will reflect on the court’s first two years in operation and to provide a forum for review, discussion, and forward-thinking dialogue amongst the legal profession.

The programme will feature:

  • Perspectives from UPC judges across different divisions
  • Analysis of key developments
  • Business strategy and the role of UK patent attorneys within the UPC

Koen Bijvank, Brinkhof
Koen Bijvank, Brinkhof

Koen is a partner at Brinkhof in Amsterdam. He is qualified both as an attorney-at-law and as a Dutch and European patent attorney. Koen holds a master’s degree in organic chemistry, and his practice focusses mainly on the chemical, pharmaceutical and biotechnology sectors.

He handles international patent disputes before courts and at the European Patent Office. Koen represents various multinational companies in court or at the EPO in opposition proceedings. He acts, for instance, as lead advocate for The Broad Institute of MIT and Harvard in the defence of its patents on CRISPR technology in numerous opposition proceedings before the EPO and he has represented Amgen in its battles with Sanofi and Regeneron about PCSK9 antibodies before the UPC and the EPO.

Koen is also a former president and co-founder of EPLIT and the chair of the standing committee on patents of AIPPI. In addition, he is a member of the Disciplinary Board of Appeal of the EPO.

Darren Smyth, EIP Europe LLP
Darren Smyth, EIP Europe LLP

Darren Smyth is a UK and European Patent Attorney, and was the head of EIP’s chemistry practice group EIP Elements until 2023.  He now holds the position of Head of Knowledge, and is known as an authoritative commentator on IP issues, having been a regular contributor to the IPKat weblog and the Journal of Intellectual Property Law & Practice, and contributing the UPC reports to the CIPA Journal.  His practice is now heavily focussed on contentious work including EPO oppositions and UPC litigation.

Darren has a masters degree in chemistry and DPhil in synthetic organic chemistry from the University of Oxford, and worked in Japan for two years at the Tokyo Institute of Technology before entering the patent profession.  Darren is an honorary professor at Queen Mary, University of London, where he teaches the Certificate and Masters courses aimed at trainee patent and trade mark attorneys.

Darren serves on the committee of IP Out, the LGBTQ+ community group within the IP Inclusive initiative in the UK Intellectual Property professions, and was a speaker at its inaugural event.  He is the convenor of the EIPride group within EIP.

Fred Nicolle, Simmons and Simmons LLP
Fred Nicolle, Simmons and Simmons LLP

Fred is a UK and European Patent Attorney and European Patent Litigator in the Simmons & Simmons IP Group. He specialises in chemistry and life sciences with an emphasis on contentious patent proceedings in oppositions before the European Patent Office and in litigation before the UPC and national courts. He completed his European Patent Litigation Certificate (EPLC) at the Academy of European Law (ERA) in association with Maastricht University and is now working in relation to UPC and EPO opposition proceedings concerning COVID-19 vaccines. He is a silver ranked individual for patent prosecution in the UK and recommended for the European Patent Office by IAM which reports “Sought after for his expertise in contentious proceedings at the UKIPO and EPO, Frederick Nicolle is a clear and confident advocate.

The Patent Mediation and Arbitration Centre (PMAC) of the Unitary Patent Court (UPC) has now opened its doors. This session will explore the role of this new institution in the resolution of patent disputes, examining the strategic opportunities it presents for litigants.

Dr Maxence Rivoire, King’s College London

Maxence Rivoire is a Lecturer in Law at King’s College London, where he is also the Director of the LLB in English Law and Master 1 in French Law. Prior to becoming an academic, he was an arbitration lawyer at Freshfields in Paris. His research mainly focuses on arbitration, intellectual property, and private international law, with a strong emphasis on the comparative aspects of these disciplines. He is currently completing a monograph titled “The Principles of Territoriality in Intellectual Property Arbitration”.

Aleš Zalar has served as a judge and President of the District Court of Ljubljana, as well as President of the Slovenian Judges Association. He was Slovenia’s Minister of Justice from 2008 to 2012 and also held the position of Acting Minister of Home Affairs for six months between 2011 and 2012.

 

For more than a decade, he has served as President of the European Centre for Dispute Resolution (ECDR), working as a mediator, arbitrator, and consultant on international rule-of-law reforms. His work in the field of mediation has been widely recognized through numerous awards and professional distinctions.

 

In September 2024, he was appointed Director of PMAC.

Dr Christopher Stothers, Freshfields LLP

Christopher is an experienced patent litigator, managing strategic, cross-border disputes around Europe and beyond, including oppositions and appeals before the European Patent Office as a legal practitioner and disputes before the Unified Patent Court as a UPC Representative. He has particular expertise in pharmaceuticals, biotechnology, medical devices and telecommunications, and is well known for his work on the interface between IP, competition and regulatory law. Christopher also helps clients with other intellectual property, antitrust and pharmaceutical regulatory litigation, arbitration and mediation. He is a creative problem-solver who thinks laterally across the breadth of his practice and has been involved in patent disputes around the world.

Christopher is a Visiting Professor in Intellectual Property and Competition Law at University College London, where he has supervised doctoral students on patent and FRAND issues with Professor Sir Robin Jacob and Matt Fisher. He published the leading textbook “Parallel Trade in Europe: Intellectual Property. Competition and Regulatory Law”. He is also committed to pro bono matters, having taken cases and interventions involving (trans) gender, disability rights and human trafficking through the Tribunal system and up to the Court of Appeal, Supreme Court, European Court of Justice and European Court of Human Rights.

Ronny Thomas is the Presiding Judge of Panel 1 at the UPC Local Division in Düsseldorf. In this role, he has been involved in numerous landmark decisions of the UPC, including, Fujifilm v Kodak and Dolby v Beko. Furthermore, in his capacity as a Presiding Judge, he has played a key role in shaping UPC case law on orders for inspection and the preservation of evidence. The Düsseldorf Local Division has handed down a series of landmark rulings in this area. The same applies to the ordering of provisional measures, particularly with regard to trade fairs and the pharmaceutical sector.

 

Additionally, Ronny Thomas was a member of the UPC’s first Presidium, playing a key role in establishing the UPC’s organisational framework.

 

Prior to joining the UPC, he was a member of one of the panels dealing with patent law at the Düsseldorf Higher Regional Court for many years, most recently serving as Deputy Presiding Judge.

 

He is a regular speaker at conferences, where he discusses the latest developments in European patent law and at the UPC. He is also the co-author of several publications on UPC matters.

Elisabetta holds a Master Degree in Mechanical Engineering and a PhD in Biomechanics.

She is V.P. of the Ordine dei Consulenti in P.I. (the Italian Institute of IP Consultants).

Elisabetta is enrolled with the Register of Court-Appointed Experts on Industrial Property of the Court of Rome.

Elisabetta teaches European Patent practice and strategies in courses leading up to European Patent Attorney qualification exams organised by the Centre d’Etudes Internationales de la Propriété Industrielle (R. Judge Samuel Granata, Unified Patent Court
Judge Samuel Granata, Unified Patent Court

Before his appointment as judge, Samuel Granata was an IP-lawyer/mediator and university assistant at the Catholic University of Law (Louvain, Belgium).

 

Before being appointed as full time legally qualified judge at the UPC, Samuel acted as a judge on a national (Court of Appeal Antwerp/Belgium – IP and Distribution Law Chamber) and international level (Benelux Court of Justice). Further, Samuel acted as President of the Disciplinary Board of the Institute of Belgian Patent Agents.

 

He was an external legal member of the Enlarged Board of Appeal (EPO) between 2012 and 2023 and was a member of “EU Commission Expert Group on Licensing and Valuation of Standard Essential Patents” between 2018 and 2020.

 

Samuel is a member of the Conseil Benelux de la Propriété Intellectuelle, a permanent member of the Belgian Federal Advisory Board for Intellectual Property (industrial property section) and sits in the editorial board of an IP journal (IRDI – KLUWER).

 

He is a frequent speaker at legal events and wrote a number of articles in the IP field.

Hon. Paolo Catallozzi is currently a judge at the Supreme Court of Italy, assigned to the first civil chamber, and ordinarily deals with cases in the field of intellectual property and competition law, as well as banking, corporate and bankruptcy law.

Paolo has been appointed as legally qualified judge of Unified Patent Court, assigned to the Court of Appeal of Luxembourg.

Previously he has been a judge at the Enterprise Court of First Instance of Rome, where he dealt with intellectual property and competition law proceedings, as well as with other business law cases, and, earlier, at other district courts where he primary dealt with civil law proceedings; he also had a stint at legislative offices of Italian ministries (Cabinet of ministers) where he cooperated in government activities.

Paolo has been a member of Enlarged Board of Appeal of the European Patent Office from 2021 to 2023.

He regularly cooperates with Italian School of Magistrates, ERA, EJTN and European Commission on judicial training programs.

Paolo has been a teacher at post graduated law schools, has several publications on intellectual property and enterprise law and has been a speaker at many conferences on those subjects, in Italy and abroad.

He is a regular participant at judges’ forums organized by World Intellectual Property Office (WIPO), European Union Intellectual Property Office (EUIPO) and European Patent Office (EPO).

Agathe represents clients in major UPC litigation as well as cross-border patent litigation. A UPC representative admitted to the German and French bars, she has litigated patents in France, the UK, and Germany, and has represented clients in EPO oppositions for over ten years. Drawing on that experience, Agathe understands the practicalities of a successful litigation strategy when it involves judges coming from multiple countries which is key at the UPC. She’s been leading cases from day 1 at the UPC and has experience in both LDs and CDs as well as at the Court of Appeal. Agathe is a partner in the Dispute Resolution practice group at Carpmaels.

Eden is an associate in the patent litigation team at Bristows. He has particular experience of UPC advocacy, including appearances before the Hague Local Division, the Paris Local Division and the UPC Court of Appeal. Before moving into litigation, he trained and qualified as a patent attorney in both Europe and the UK, and now draws on that background in contentious work before the English courts and the UPC.

His contentious practice focuses on high-tech patent disputes, with experience spanning telecommunications, medical devices, molecular diagnostics and AI.

Studying in Munich, Hamburg and Chicago, Mathias obtained a masters degree in mechanical engineering in 1995 before qualifying as a German and European patent attorney in 1999. As an equity partner of COHAUSZ & FLORACK, Mathias is primarily concerned with obtaining, attacking and defending IP rights in these areas, strategic counseling and portfolio development. Mathias particularly specialises in patent opposition and nullity procedures.

Conor is an Associate with 9 years’ experience in Dehns’ Tech, Software, and Engineering (TSE) department. With a background in physics, Conor advises clients in a range of fields such as aeronautics, green tech, and medical devices.

In the UPC, Conor has defended clients in several actions at several Divisions, including the first action to be heard at the Paris CD, Bitzer v Carrier. Conor’s experience has enabled him to give up-to-date practical advice to clients and colleagues.

In addition to their case work, Conor is a regular contributor to the CIPA Journal on UPC case law developments. Conor has also given several talks and presentations on aspects of the UPC, written for Landslide, the American Bar Association’s trade magazine, and received a Highly Commended Award from AIPPI.

Richard Davis, Hogarth Chambers

Richard Davis KC has over 20 years’ experience litigating before the English Patents Court as well as oppositions and appeals before the EPO and is equally familiar with both jurisdictions. In March 2025 he became the first UK barrister to appear before the Unified Patent Court.

Richard’s practice encompasses a diverse range of technologies. He has particular expertise in the electronics / telecommunications sector having advised many of the major players in the field such as LG Electronics, Samsung, Nokia, Motorola and Symbian. Although by training an electrical engineer, he is active in the pharmaceutical sector including SPCs. He acted for the Secretary of State for Health in the ground breaking second medical indication litigation concerning pregabalin.

Before commencing practice at the Bar, Richard qualified as a European Patent Attorney and this dual qualification has resulted in him appearing frequently before the European Patent Office often in cases of concurrent UK litigation. He has audience rights before the Unified Patents Court.

Richard is equally at home with the other intellectual property rights and has carved a niche in designs and ‘difficult’ copyright cases including Temple Island v New English Teas (the red bus case). He is one of the few counsel to have appeared before the CJEU on a designs matter and one of the very few to have appeared before the UK Registered Designs Appeal Tribunal (as it then was). He has been involved in a number of cases which have pushed the boundaries of what it protectable under the law of copyright and database rights.

Richard was one of the inaugural tutors at Nottingham Law School on its LLM in Advanced IP litigation and has been a visiting lecturer of CEIPI on the European patent litigation diploma. He is currently one of the two General Editors of the CIPA Guide to the Patents Acts (the Black Book).

In 2019 Richard was appointed as a criminal Recorder giving him a very different and judicial insight into the conduct of proceedings. He has presided over jury trials involving including inflicting grievous bodily harm, child cruelty, aggravated arson and burglary.

Richard spends much of his spare time flying his ‘home-build’ aeroplane which first took to the skies in 2020.

Alex Wilson is a founding partner of Powell Gilbert www.powellgilbert.com, a specialist European IP law firm with offices in London, Dusseldorf, and Dublin.

He is a UK Solicitor Advocate, Irish Solicitor and UPC Representative. He guides clients from a wide range of industries on strategies for exploiting and enforcing of patents in national and UPC courts across Europe as well other major markets. He has handled a number of the leading SEP cases in the UPC and is on the PMAC FRAND Guidelines Working Group.

He is joint editor of an international commentary: Unified Patent Court Procedure, Beck 2025 and was actively involved in teaching legal and technical Judges for the Court. Alex is a Vice President of the European Patent Lawyers’ Association (EPLAW) and chairs its Japan and Korea Outreach and ADR committees.

Dr Clemens-August Heusch LL.M is VP and Head of Global Litigation and Disputes at Nokia, responsible for arbitration, mediation and multi-national litigation.

Registered at the Cologne Bar and a certified IP lawyer, Clemens studied at the Universities of Freiburg, Bonn and Cologne, Germany and Maastricht, Netherlands. He joined Nokia in 2008 from Bird & Bird LLP.

Both a patent attorney and a solicitor, Andrew is head of the UK litigation team at EIP and has been responsible for litigation ranging from IPEC to the Supreme Court, and the co-ordination of multi-national litigation campaigns. Matt Dixon is the Immediate Past President of the Chartered Institute of Patent Attorneys (CIPA) and Executive Chair at Beck Greener LLP.

Passionate about building motivated teams backed by efficient systems to grow successful businesses, Matt has held significant leadership positions in several notable UK patent and trade mark firms. For over 15 years, he has been a prominent member of the Council of the Chartered Institute of Patent Attorneys, the UK’s largest membership organisation in the field of intellectual property, serving as CIPA’s elected President in 2024. On behalf of CIPA he has actively promoted the capability of UK patent attorneys to represent before the Unified Patent Court (UPC) and has provided evidence to UK Government regarding support for innovative SME businesses.

Matt’s technical expertise covers the broad fields of physics, engineering, electronics and software, working with companies in sectors as diverse as medical devices, wind turbines, robotic vehicles, online gambling, telecommunications security and air conditioning systems. In addition to providing commercially focused IP strategy advice, he has also represented major multi-national corporations in multi-party Opposition and Appeal proceedings before the European Patent Office, particularly in the field of medical devices, such as absorbent products, negative pressure wound therapy, auto-injectors and super-resolution fluorescence microscopy. Recently, Matt has represented clients before the Central Division of the UPC in Paris.

Prior to joining Beck Greener, Matt worked Of Counsel for an Aberdeen-based start-up patent practice, supporting the founder with the growth of the business. He has led the London office and the Engineering team of one of the UK’s largest IP firms. He founded the London office of a new IP practice with an innovative business model based entirely on fixed fees. He trained and qualified at one of the UK’s most respected patent and trade mark practices, becoming a partner in that firm’s Munich office.

Chloe Flower, Mewburn Ellis LLP
Chloe Flower, Mewburn Ellis LLP

Chloe is a UK and European Patent Attorney and UPC representative at Mewburn Ellis LLP, specialising in medical devices and energy storage, with particular expertise in opposition and appeal proceedings before the European Patent Office and in supporting litigation before the UPC and UK courts.

She works at the interface of chemistry, materials science and engineering, advising multinational clients on European patent strategy across technologies including surgical devices, glucose monitoring systems and batteries.

Chloe’s current role includes representing clients at the EPO, including in opposition matters with co-pending UPC litigation, and representing clients at the UPC alongside patent litigator specialists. She has supported cases before the UPC involving technologies such as sugar processing and continuous glucose monitoring systems and has experience handling expert evidence in that forum. Her broader contentious work informs her strategic approach to both disputes and portfolio management.

Chloe serves on the Women in IP Careers Guidance committee and is the editor of the European Patents Handbook Chapter on the Rules of Procedure of the Boards of Appeal.

Conor Wilman, Dehns

Conor is an Associate with 9 years’ experience in Dehns’ Tech, Software, and Engineering (TSE) department. With a background in physics, Conor advises clients in a range of fields such as aeronautics, green tech, and medical devices.

In the UPC, Conor has defended clients in several actions at several Divisions, including the first action to be heard at the Paris CD, Bitzer v Carrier. Conor’s experience has enabled him to give up-to-date practical advice to clients and colleagues.

In addition to their case work, Conor is a regular contributor to the CIPA Journal on UPC case law developments. Conor has also given several talks and presentations on aspects of the UPC, written for Landslide, the American Bar Association’s trade magazine, and received a Highly Commended Award from AIPPI.

Rob formed and chairs CIPA’s UPC Committee, and has appeared before the UPC, including the Oral Hearing of the first case to be filed at the Paris Central Division, and before its Court of Appeal. Rob’s background is in physics and he is also experienced in patent prosecution and contentious matters before both the IPO and EPO.
